The Building Blocks of Music Ownership

Masters are the actual recordings. Protecting them is primarily the label’s job. If someone uses a recording without authorization, the label is usually the party with standing to go after it. Publishing covers the composition, meaning the melody and the lyrics, not the recording of it. A label might own the master while the artist or a publisher owns the publishing. These are two completely separate revenue streams. If an AI-generated track leans on an existing composition, the publishing rights holder is the one with a claim.
Performance rights are managed through PROs like ASCAP, BMI, and SESAC. This is on the artist to set up. The label does not do it for you. NIL covers your voice, your name, your face, and your overall identity. This is squarely on the artist to protect. Labels do not own your NIL and cannot enforce it on your behalf. Most artists do not even know when it is happening.
Why Split Rights Make Everything Harder
Even when you know what you own, you might not own all of it. Co-written songs mean shared publishing. Early label deals often handed over masters for the life of copyright. Features and samples add more rights holders to the equation. The more people who have a stake, the harder it is to move fast when something goes wrong. And when an AI platform is using your catalog without permission, speed matters.
How Streaming Changed Everything First
Before streaming, buying music meant buying a copy. The transaction was simple, the ownership was clear, and revenue was predictable. Streaming changed all of that. AI platforms have been training on copyrighted recordings without licensing them. The RIAA cases against Suno and Udio, backed by Universal, Sony, and Warner, are the clearest example. But the bigger gap is NIL. Copyright protects recordings and compositions. It does not protect vocal style or artistic identity. As a Latham and Watkins partner told Congress: writing a song in the style of Taylor Swift is not copyright infringement. That is a founding principle of copyright law*. Which means the standard legal hooks simply do not apply to AI-generated content using cloned voices. Most contracts were not written to deal with this at all.

Honestly, right now it is hard. DMCA takedowns work for clear infringement but get murky fast with AI-generated content that does not directly copy a recording. Litigation is expensive and slow. Even the RIAA needed three major labels behind them to make it happen. Sony Music alone has already requested the removal of over 135,000 AI deepfake songs impersonating artists including Beyonce, Harry Styles, and Queen. That is one label.
